Legal Disclaimer
The information provided in this article is for educational and informational purposes only and does not constitute legal advice. Cannabis laws vary significantly by jurisdiction. Marijuana may not be transported across state lines, and possessing marijuana in a state where it remains illegal violates that state’s laws. Please consult your local laws and state officials regarding specific regulations in your area of residence.
Wisconsin: Cannabis, Hemp, and CBD Legal Status
Cannabis plants contain various cannabinoids, including CBD and THC. Legally, cannabis products containing a THC concentration of 0.3% or less on a dry-weight basis are classified as hemp. Products exceeding this 0.3% threshold are classified as marijuana. Both hemp and marijuana are subject to a complex patchwork of federal and state-specific regulations.
In Wisconsin, the legal framework for hemp-derived CBD products was established by the 2018 Federal Farm Bill and 2019 Wisconsin Act 68. Under these laws, adults can purchase hemp-derived CBD products over-the-counter at health stores, specialty shops, and other retail outlets without a medical card or prescription, provided the product adheres to the 0.3% Delta-9 THC limit.
Conversely, the production, sale, possession, and consumption of marijuana remain illegal under Wisconsin state law for both medical and recreational purposes. While Wisconsin does not have a statewide decriminalization policy, certain local municipalities and counties have passed ordinances reducing penalties for minor possession. It is important to note that local decriminalization is not legalization; these ordinances simply grant local law enforcement the option to issue a civil citation rather than make a criminal arrest. State and federal laws still apply across the state. Wisconsinites interested in advocacy and policy reform can connect with organizations like the Marijuana Policy Project, which works directly with lawmakers to educate and advance cannabis law changes.
Please come back when you are 21+ years old (or 18+ with a valid medical marijuana card).
